Statement of Rights and Responsibilities

This Statement of Rights and Responsibilities ("Statement," "Terms," or "SRR") is our terms of service that governs our relationship with users and others who interact with TagTaste, as well as TagTaste brands, products and services, which we call the “TagTaste Services” or “Services”. By using or accessing the TagTaste Services, you agree to this Statement, as updated from time to time in accordance with Section 9 below. Additionally, you will find resources at the end of this document that help you understand how TagTaste works. Because TagTaste provides a wide range of Services, we may ask you to review and accept supplemental terms that apply to your interaction with a specific app, product, or service. To the extent those supplemental terms conflict with this SRR, the supplemental terms associated with the app, product, or service govern with respect to your use of such app, product or service to the extent of the conflict.

  1. Privacy
  2. Your privacy is very important to us. We designed our Privacy Policy to make important disclosures about how you can use TagTaste to share with others and how we collect and can use your content and information.

  3. Sharing Your Content and Information
  4. You own all of the content and information you post on TagTaste, and you can control how it is shared among the TagTaste community. In addition:

    1. For content that is covered by intellectual property rights, like photos and videos (IP content), you specifically give us the following permission, subject to your privacy settings: you grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use any IP content that you post on or in connection with TagTaste (IP License). This IP License ends when you delete your IP content or your account unless your content has been shared with others, and they have not deleted it.

    2. When you delete IP content, it is deleted in a manner similar to emptying the recycle bin on a computer. However, you understand that removed content may persist in backup copies for a reasonable period of time (but will not be available to others).

    3. When you publish content or information using the Public setting, it means that you are allowing everyone, including people off of TagTaste, to access and use that information, and to associate it with you (i.e., your name and profile picture).

    4. We always appreciate your feedback or other suggestions about TagTaste, but you understand that we may use your feedback or suggestions without any obligation to compensate you for them (just as you have no obligation to offer them).

  5. Safety
  6. We do our best to keep TagTaste safe, but we cannot guarantee it. We need your help to keep TagTaste safe, which includes the following commitments by you:

    1. You will not post unauthorized commercial communications (such as spam) on TagTaste.

    2. You will not collect users' content or information, or otherwise access TagTaste, using automated means (such as harvesting bots, robots, spiders, or scrapers) without our prior permission.

    3. You will not engage in unlawful multi-level marketing, such as a pyramid scheme, on TagTaste.

    4. You will not upload viruses or other malicious code.

    5. You will not solicit login information or access an account belonging to someone else.

    6. You will not bully, intimidate, or harass any user.

    7. You will not post content that: is hate speech, threatening, or pornographic; incites violence; or contains nudity or graphic or gratuitous violence.

    8. You will not develop or operate a third-party application containing alcohol-related, dating or other mature content (including advertisements) without appropriate age-based restrictions.

    9. You will not use TagTaste to do anything unlawful, misleading, malicious, or discriminatory.

    10. You will not do anything that could disable, overburden, or impair the proper working or appearance of TagTaste, such as a denial of service attack or interference with page rendering or other TagTaste functionality.

    11. You will not facilitate or encourage any violations of this Statement or our policies.

  7. Registration and Account Security
  8. TagTaste users provide their real names and information, and we need your help to keep it that way. Here are some commitments you make to us relating to registering and maintaining the security of your account:

    1. You will not provide any false personal information on TagTaste, or create an account for anyone other than yourself without permission.

    2. You will not create more than one personal account.

    3. If we disable your account, you will not create another one without our permission.

    4. You will not use your personal timeline primarily for your own commercial gain, and will use a TagTaste dedicated services such as Job Portal & Collaboration Pages for such purposes.

    5. You will not use TagTaste if you are under 18.

    6. You will not use TagTaste if you are a convicted sex offender.

    7. You will keep your contact information accurate and up-to-date

    8. You will not share your password (or in the case of developers, your secret key), let anyone else access your account, or do anything else that might jeopardize the security of your account.

    9. You will not transfer your account (including any Page or application you administer) to anyone without first getting our written permission.

    10. If you select a username or similar identifier for your account or Page, we reserve the right to remove or reclaim it if we believe it is appropriate (such as when a trademark owner complains about a username that does not closely relate to a user's actual name).

  9. Protecting Other People's Rights
  10. We respect other people's rights, and expect you to do the same.

    1. You will not post content or take any action on TagTaste that infringes or violates someone else's rights or otherwise violates the law.

    2. We can remove any content or information you post on TagTaste if we believe that it violates this Statement or our policies.

    3. If we remove your content for infringing someone else's copyright, and you believe we removed it by mistake, we will provide you with an opportunity to appeal.

    4. If you repeatedly infringe other people's intellectual property rights, we will disable your account when appropriate.

    5. You will not use our copyrights or Trademarks or any confusingly similar marks, except as expressly permitted by our Brand Usage Guidelines or with our prior written permission.

    6. If you collect information from users, you will: obtain their consent, make it clear you (and not TagTaste) are the one collecting their information, and post a privacy policy explaining what information you collect and how you will use it.

    7. You will not post anyone's identification documents or sensitive financial information on TagTaste.

    8. You will not tag users or send email invitations to non-users without their consent. TagTaste offers social reporting tools to enable users to provide feedback about tagging.

  11. Mobile and Other Devices
    1. We currently provide our mobile services for free, but please be aware that your carrier's normal rates and fees, such as text messaging and data charges, will still apply.

    2. In the event you change or deactivate your mobile telephone number, you will update your account information on TagTaste within 48 hours to ensure that your messages are not sent to the person who acquires your old number.

    3. You provide consent and all rights necessary to enable users to sync (including through an application) their devices with any information that is visible to them on TagTaste.

  12. About Advertisements and Other Commercial Content Served or Enhanced by TagTaste
  13. Our goal is to deliver advertising and other commercial or sponsored content that is valuable to our users and advertisers. In order to help us do that, you agree to the following:

    1. You give us permission to use your name, profile picture, content, and information in connection with commercial, sponsored, or related content (such as a brand you like) served or enhanced by us. This means, for example, that you permit a business or other entity to pay us to display your name and/or profile picture with your content or information, without any compensation to you. If you have selected a specific audience for your content or information, we will respect your choice when we use it.

    2. We do not give your content or information to advertisers without your consent.

    3. You understand that we may not always identify paid services and communications as such.

  14. Special Provisions Applicable to Software
    1. If you download or use our software, such as a stand-alone software product, an app, or a browser plugin, you agree that from time to time, the software may download and install upgrades, updates and additional features from us in order to improve, enhance, and further develop the software.

    2. You will not modify, create derivative works of, decompile, or otherwise attempt to extract source code from us, unless you are expressly permitted to do so under an open source license, or we give you express written permission.

  15. Amendments
    1. We’ll notify you before we make changes to these terms and give you the opportunity to review and comment on the revised terms before continuing to use our Services.

    2. If we make changes to policies, guidelines or other terms referenced in or incorporated by this Statement, we may provide notice on the Site Governance Page.

    3. Your continued use of the TagTaste Services, following notice of the changes to our terms, policies or guidelines, constitutes your acceptance of our amended terms, policies or guidelines.

  16. Termination
  17. If you violate the letter or spirit of this Statement, or otherwise create risk or possible legal exposure for us, we can stop providing all or part of TagTaste to you. We will notify you by email or at the next time you attempt to access your account. You may also delete your account or disable your application at any time. In all such cases, this Statement shall terminate, but the following provisions will still apply: 2.2, 2.3, 3-5, and 10-18.

  18. Disputes
    1. You will resolve any claim, cause of action or dispute (claim) you have with us arising out of or relating to this Statement or TagTaste exclusively in the Indian Court located in the city of New Delhi, and you agree to submit to the personal jurisdiction of such courts for the purpose of litigating all such claims. The laws of the State of National Capital of India, New Delhi will govern this Statement, as well as any claim that might arise between you and us, without regard to conflict of law provisions.

    2. If anyone brings a claim against us related to your actions, content or information on TagTaste, you will indemnify and hold us harmless from and against all damages, losses, and expenses of any kind (including reasonable legal fees and costs) related to such claim. Although we provide rules for user conduct, we do not control or direct users' actions on TagTaste and are not responsible for the content or information users transmit or share on TagTaste. We are not responsible for any offensive, inappropriate, obscene, unlawful or otherwise objectionable content or information you may encounter on TagTaste. We are not responsible for the conduct, whether online or offline, of any user of TagTaste.

    3. WE TRY TO KEEP TAGTASTE UP, BUG-FREE, AND SAFE, BUT YOU USE IT AT YOUR OWN RISK. WE ARE PROVIDING TAGTASTE AS IS WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT TAGTASTE WILL ALWAYS BE SAFE, SECURE OR ERROR-FREE OR THAT TAGTASTE WILL ALWAYS FUNCTION WITHOUT DISRUPTIONS, DELAYS OR IMPERFECTIONS. TAGTASTE IS NOT RESPONSIBLE FOR THE ACTIONS, CONTENT, INFORMATION, OR DATA OF THIRD PARTIES, AND YOU RELEASE US, OUR DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS FROM ANY CLAIMS AND DAMAGES, KNOWN AND UNKNOWN, ARISING OUT OF OR IN ANY WAY CONNECTED WITH ANY CLAIM YOU HAVE AGAINST ANY SUCH THIRD PARTIES. WE WILL NOT BE LIABLE TO YOU FOR ANY LOST PROFITS OR OTHER CONSEQUENTIAL, SPECIAL, INDIRECT, OR INCIDENTAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THIS STATEMENT OR TAGTASTE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY ARISING OUT OF THIS STATEMENT OR TAGTASTE WILL NOT EXCEED THE GREATER OF ONE HUNDRED INDIAN RUPEES (INR 100) OR THE AMOUNT YOU HAVE PAID US IN THE PAST TWELVE MONTHS. APPLICABLE LAW MAY NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY OR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. IN SUCH CASES, TAGTASTE’S LIABILITY WILL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

    Special Provisions Applicable to Users Outside India

    We strive to create a global community with consistent standards for everyone, but we also strive to respect local laws. The following provisions apply to users and non-users who interact with TagTaste outside India:

    1. You consent to having your personal data transferred to and processed in India.

    2. If you are located in a country embargoed by India, you will not engage in commercial activities on TagTaste (such as advertising or payments) or operate a Platform application or website. You will not use TagTaste if you are prohibited from receiving products, services, or software originating from India.

    Definitions

    1. By "TagTaste" or” TagTaste Services” we mean the features and services we make available, including through (a) our website at www.TagTaste.com and any other TagTaste branded or co-branded websites (including sub-domains, international versions, widgets, and mobile versions); (b) our Platform; (c) social plugins such as the Like button, the Share button and other similar offerings; and (d) other media, brands, products, services, software (such as a toolbar), devices, or networks now existing or later developed. TagTaste reserves the right to designate, in its sole discretion, that certain of our brands, products, or services are governed by separate terms and not this SRR.

    2. By "Platform" we mean a set of APIs and services (such as content) that enable others, including application developers and website operators, to retrieve data from TagTaste or provide data to us.

    3. By "information" we mean facts and other information about you, including actions taken by users and non-users who interact with TagTaste.

    4. By "content" we mean anything you or other users post, provide or share using TagTaste Services.

    5. By "data" or "user data" or "user's data" we mean any data, including a user's content or information that you or third parties can retrieve from TagTaste or provide to TagTaste through Platform.

    6. By "post" we mean post on TagTaste or otherwise make available by using TagTaste.

    7. By "use" we mean use, run, copy, publicly perform or display, distribute, modify, translate, and create derivative works of.

    8. By "application" we mean any application or website that uses or accesses Platform, as well as anything else that receives or has received data from us. If you no longer access Platform but have not deleted all data from us, the term application will apply until you delete the data.

    Other

    1. This Statement is an agreement between you and TagTaste Foods Pvt. Ltd. References to “us,” “we,” and “our” mean TagTaste Foods Pvt. Ltd.

    2. This Statement makes up the entire agreement between the parties regarding TagTaste, and supersedes any prior agreements.

    3. If any portion of this Statement is found to be unenforceable, the remaining portion will remain in full force and effect.

    4. If we fail to enforce any of this Statement, it will not be considered a waiver.

    5. Any amendment to or waiver of this Statement must be made in writing and signed by us.

    6. You will not transfer any of your rights or obligations under this Statement to anyone else without our consent.

    7. All of our rights and obligations under this Statement are freely assignable by us in connection with a merger, acquisition, or sale of assets, or by operation of law or otherwise.

    8. Nothing in this Statement shall prevent us from complying with the law.

    9. This Statement does not confer any third party beneficiary rights.

    10. We reserve all rights not expressly granted to you.

    11. You will comply with all applicable laws when using or accessing TagTaste.

    By using or accessing TagTaste Services, you agree that we can collect and use such content and information in accordance with the Privacy Policy as amended from time to time. You may also want to review the following documents, which provide additional information about your use of TagTaste:

Privacy Policy

Introduction

Our registered users (“Members”) share their professional identities, engage with their network, exchange knowledge and professional insights, post and view relevant content, learn and find business and career opportunities. Content on some of our services is available to non-members (“Visitors”).

Data Controllers

You are entering into the User Agreement with TagTaste Foods Pvt. Ltd., who will be responsible for your personal data provided to, or collected by or for, our Services.

Services

This Privacy Policy applies to www.TagTaste.com, TagTaste-branded apps, communications and services (“Services”), including tools such as Like, Share, Posts etc., but excluding services that state that they are offered under a different privacy policy.

Consent

If you use our Services, you consent to the collection, use and sharing of your personal data under this Privacy Policy and agree to the Terms & Conditions.

Change

We may modify this Privacy Policy, and if we make material changes to it, we will provide notice through our Services, or by other means, to provide you the opportunity to review the changes before they become effective. If you object to any changes, you may close your account. Your continued use of our Services after we publish or send a notice about our changes to this Privacy Policy means that you are consenting to the updated Privacy Policy.

      To create an account you provide data including your name, email address and/or mobile number, and a password. If you register for a premium Service, we may ask you for payment (e.g., credit card) and billing information.

      Profile

      You have choices about the information on your profile, such as your education, work experience, skills, photo, city or area and endorsements. Profile information helps you to get more from our Services, including helping recruiters and business opportunities find you. It’s your choice whether to include sensitive information on your profile. Please do not post or add personal data to your profile that you would not want to be publicly available.

      Posting and Uploading

      We collect personal data from you when you provide, post or upload it to our Services, such as when you fill out a form, respond to a survey (e.g., Members’ salary), submit a resume and apply for or save jobs or send invitations. If you opt to import your address book, we receive your contacts (including contact information your service provider(s) or app automatically added to your address book when you communicated with addresses or numbers not already in your list). If you sync your email or calendars with our Services, we will collect your “email header” and calendar meeting information (e.g. times, places, attendees and contacts).

    4. Content and News

      You and others may post content that includes information about you on our Services (as part of blog posts, feed updates and comments, videos). We collect public information about you, such as professional-related news and accomplishments (e.g., patents granted, professional recognition, conference speakers, projects, etc.) and make it available as part of our Services (e.g. suggestions for your profile, or notifications of mentions in the news).

      Contact and Calendar Information

      We receive personal data about you when others import or sync their address book or calendar with our Services, or send messages using our Services (including invites or connection requests).

      Partners

      We receive personal data about you when you use the services of our customers and partners, such as prospective employers and applicant tracking systems providing us job application data.

We log usage data when you visit or otherwise use our Services, including our sites, app and platform technology (e.g., our off-site plugins), such as when you view or click on content or ads (on or off our sites and apps), perform a search, install one of our mobile apps, share articles or apply for jobs or collaborative projects. We use log-ins, cookies, device information and internet protocol (“IP”) addresses to identify you and log your use.

    8. We use cookies to recognize you and/or your device(s) on, off and across different Services and devices. You can control cookies through your browser settings and other tools.

    9. Your Device and Location
    10. When you visit or leave our Services (including our plugins or cookies or similar technology on the sites of others), we receive the URL of both the site you came from and the one you go to next. We also get information about your IP address, proxy server, operating system, web browser and add-ons, device identifier and features, and/or ISP or your mobile carrier. If you use our Services from a mobile device, that device will send us data about your location. Most devices allow you to prevent location data from being sent to us and we honor your settings.

    11. Messages
    12. We collect information about you when you send, receive, or engage with messages in connection with our Services. For example, if you get a TagTaste follower, we track whether you have acted on it and will send you reminders.

    13. Workplace Provided Information
    14. An employer (or other person or entity procuring our Services for your use) may provide us information about their employees or contractors who make use of these Services. For example, we will get contact information for “Company Page” administrators and for authorizing users of our premium Services, such as our recruiting and collaborating services.

    16. We receive information about your visits and interaction with services provided by others when you log-in with TagTaste or visit others’ services that include our plugins (such as “Share on TagTaste” or “Apply with TagTaste”), ads, cookies or similar technologies.

    17. Other
    18. Our Services are dynamic and we often introduce new features, which may require the collection of new information. If we collect materially different personal data or materially change how we use your data, we will notify you and may also modify this Privacy Policy.

  3. How we use your personal data will depend on which Services you use, how you use those Services and the choices you make in your settings. We use the data that we have about you to provide, support, personalize and make our Services (including ads) more relevant and useful to you and others.

      Stay Connected

      Our Services allow you to stay in touch, in communication and up to date with colleagues, partners, clients, and other professional contacts. To do so, you will “follow” professionals who you choose, and they can “follow” you back. We will use data about you (such as profiles you have viewed or data provided through address book uploads or partner integrations) to suggest connections for you and others (e.g. Members who share your contacts) and enable you to invite others to become a Member and connect with you. It is your choice whether to invite someone to our Services, send a connection request. When you invite someone to join TagTaste, your invitation will include your name, photo, network and contact information. We will send invitation reminders to the person you invited.

      Stay Informed

      Our Services allow you to stay informed about news, events and ideas regarding professional topics you care about, and from professionals you respect. Our Services also allow you to improve your professional skills, or learn new ones. We use the information about you to recommend relevant content across our Services, suggest skills you may have to add to your profile and skills that you might need to pursue your next opportunity. So, if you let us know that you are interested in a new skill (e.g., by watching certain jobs or collaborative projects), we will use this information to personalize content in your feed, suggest that you follow certain members on our site, or watch related learning content to help you towards that new skill. We use your content, activity and other data, including your name and picture, to provide notices to your network and others. For example, subject to your settings, we may notify others that you have updated your profile, posted a blog, took a social action, made new connections or were mentioned in the news.

      Career

      Our Services allow you to explore careers, evaluate educational opportunities, and seek out, and be found for, career opportunities. Your profile can be found by those looking to hire (for a job or a specific task) or be hired by you. We will use your data to recommend jobs, show you and others who work at a company, in a function or location or have certain skills and connections. You can signal that you are interested in changing jobs and share information with job recruiters. We may use your profile and activity to recommend jobs to you and you to recruiters.

      Productivity

      Our Services allow you to collaborate with colleagues, search for potential clients, customers, partners and others to do business with. Our Services allow you to communicate with other professionals and schedule and prepare meetings with them. Subject to your settings, we scan messages to provide “bots” or similar tools that facilitate tasks such as scheduling meetings, draft responses, summarize messages or recommend next steps.

  5. We will contact you through email, notices posted on our websites or apps, messages to your TagTaste inbox, and other ways through our Services, including text messages and push notifications. We will send you messages about the availability of our Services, security, or other service-related issues. We also send messages about how to use the Services, network updates, reminders, job suggestions and promotional messages from us and our partners. Please be aware that you cannot opt out of receiving service messages from us, including security and legal notices.
